Penalties on hazardous waste management
Penalties meted on those found guilty of discharging of hazardous substances, chemicals and materials or oil into the environment
1. Imprisonment for a term not less than two years
2. A fine of not less than one million shillings
3. Both such imprisonment and fine
4. pay the cost of the removal of the hazardous substance, chemical, oil or a mixture containing oil including any costs which may be incurred by any Government agency or organ in the restoration of the environment damaged or destroyed as a result of the discharge
5. Pay the costs of third parties in the form of reparation, restoration, restitution or compensation as may be determined by a competent court on application by such third parties
