Access permit conditions

Conditions imposed by NEMA to holders of a biodiversity access permit


(a) Depositing of duplicates and holotypes of all genetic resources collected with the relevant lead agency.
(b) Submitting records of all intangible components of plant genetic material collected to NEMA.
(c) Guaranteeing reasonable access to all genetic resources and intangible components collected to all Kenyans whether held locally or abroad.
(d) Ensuring that all agreements entered into with respect to access to genetic resources are strictly for the purposes agreed upon.
(e) Submitting to NEMA quarterly reports on the status of research, including all discoveries from research, involving genetic resources and/or intangible components.
(f) The holder of an access permit is required to inform NEMA of all discoveries made during the exercise of the right of access granted under the permit.

(g) The holder of an access permit is required to provide the following reports –

i. Regular status reports on the environmental impacts of any ongoing collection of genetic resources or intangible components;
ii. A final status report on the environmental impacts of collection of genetic resources or intangible components, in the event that the collection is of duration of three months or less.

(h) The holder of an access permit shall abide by the laws of Kenya.

In addition to the above conditions, NEMA may include such other terms and conditions or vary them as it shall deem necessary.
