Reconsider an environmental restoration order

Instances when NEMA could reconsider an environmental restoration order


• The person served with an environmental restoration order could within twenty one days after receiving the order, write a request letter to NEMA giving reasons for reconsideration of the order.
• NEMA will inspect the facility to verify compliance to the order and consider lifting the order
• NEMA will communicate its decision in writing to the person who was served with the order
• Where NEMA exercised its power as provided in EMCA Cap 387 and spent its money to implement the order, the expenses incurred by it in the exercise of that power shall be a civil debt recoverable summarily by it from the person served with the order.
